Terms & Conditions

Effective Date: January 1st, 2026

Welcome to Gulf Coast Pinnacle Media ("Company," "we," "our," or "us"). By booking, scheduling, purchasing, or using any of our services, you ("Client") agree to be legally bound by these Terms & Conditions.

These Terms apply whether services are booked through our website, email, phone, text message, social media, or any other method.

If you do not agree to these Terms, you may not purchase or use our services.

1. Services

Gulf Coast Pinnacle Media provides professional real estate media services, including but not limited to:

• Professional Photography

• Drone Photography

• Drone Video

• Cinematic Listing Videos

• Social Media Videos

• Zillow 3D Tours

• Floor Plans

• Virtual Twilight

• Virtual Staging

• AI Media Services

• Editing Services

• Any additional media services offered by Gulf Coast Pinnacle Media.

 

2. Booking & Acceptance

A booking is considered confirmed when:

• the Client places an order;

• scheduling is confirmed by Gulf Coast Pinnacle Media;

• or payment has been received.

By confirming a booking, the Client agrees to these Terms & Conditions.

 

3. Property Readiness

The Client is responsible for ensuring the property is ready before the scheduled appointment.

This includes, but is not limited to:

• Cleaning

• Staging

• Landscaping

• Removing personal items

• Turning on lights

• Opening blinds if desired

• Ensuring pets are secured

Our photographers are not responsible for cleaning, staging, moving furniture, organizing belongings, or preparing the property.

If the property is not ready upon arrival, we will photograph it as presented unless otherwise agreed.

Additional editing requests caused by property condition may incur additional fees.

 

4. Weather

Outdoor photography and drone operations are weather dependent.

If weather conditions make shooting unsafe or produce unacceptable results, Gulf Coast Pinnacle Media reserves the right to reschedule the appointment.

 

5. Drone Operations

Drone services are subject to:

• FAA regulations

• Airspace restrictions

• Temporary Flight Restrictions (TFRs)

• Weather conditions

• Safety considerations

If drone operations cannot legally or safely be performed, drone fees may be refunded or alternative services may be offered at our discretion.

 

6. Payment

Payment is due according to the invoice terms.

Unless otherwise agreed:

• Payment is due prior to delivery of final media.

• Final media may be withheld until payment has been received in full.

Late payments may incur applicable collection costs where permitted by law.

 

7. Cancellations & Rescheduling

Appointments canceled with at least 24 hours' notice generally incur no cancellation fee.

Appointments canceled with less than 24 hours' notice may be subject to a cancellation fee.

If Gulf Coast Pinnacle Media arrives at the property and cannot perform the services due to circumstances outside our control (locked property, denied access, property not ready, etc.), a trip fee may apply.

 

8. Delivery Times

Estimated delivery times are:

• Photography: within 24 hours

• Video: approximately 3 business days

Delivery estimates are not guarantees and may vary due to workload, revisions, weather, holidays, or circumstances beyond our control.

 

9. Revisions

Reasonable editing revisions are included when requested promptly after delivery.

Requests involving additional editing, replacement images, significant retouching, virtual staging changes, or creative modifications may require additional charges.

 

10. Copyright & License

Unless otherwise agreed in writing:

Gulf Coast Pinnacle Media retains full copyright ownership of all photographs, videos, drone footage, floor plans, and other media created.

Upon full payment, the Client receives a non-exclusive, non-transferable license to use the delivered media solely for marketing the specific property for which it was created.

Media may not be:

• sold,

• transferred,

• sublicensed,

• reused for another property,

• or used by another agent without written permission.

 

11. Portfolio Use

Unless otherwise agreed in writing, Gulf Coast Pinnacle Media reserves the right to use any media produced for:

• portfolio purposes;

• social media;

• advertising;

• website galleries;

• marketing materials;

• competitions;

• educational purposes.

Clients requesting confidentiality must notify us before the scheduled appointment.

 

12. Property Access

The Client represents that they have the legal authority to authorize photography, videography, drone operations, and other media services at the property.

The Client agrees to indemnify Gulf Coast Pinnacle Media from claims arising from unauthorized access or lack of permission.

 

13. Limitation of Liability

To the maximum extent permitted by law, Gulf Coast Pinnacle Media shall not be liable for:

• indirect damages;

• consequential damages;

• lost profits;

• business interruption;

• MLS issues;

• marketing losses;

• delays caused by weather;

• FAA restrictions;

• equipment failure;

• internet outages;

• circumstances beyond our reasonable control.

Our total liability shall not exceed the amount paid by the Client for the specific services giving rise to the claim.

 

14. Image Accuracy

Photography, video, virtual staging, AI-generated media, and virtual twilight are artistic representations.

Colors, lighting, sky replacements, AI enhancements, virtual staging, and other edits may differ from actual property appearance.

Floor plans are approximate and should not be relied upon for architectural, engineering, appraisal, or legal purposes.

 

15. MLS & Platform Compliance

The Client is solely responsible for ensuring compliance with MLS rules, brokerage requirements, advertising regulations, copyright rules, and platform policies.

 

16. Force Majeure

Gulf Coast Pinnacle Media shall not be liable for delays or inability to perform services caused by events beyond our reasonable control, including but not limited to severe weather, hurricanes, flooding, fire, government action, FAA restrictions, power outages, illness, equipment failure, or acts of God.

 

17. Governing Law

These Terms shall be governed by the laws of the State of Florida.

Any disputes shall be resolved exclusively in the state or federal courts located within Florida.

 

18. Changes to These Terms

We reserve the right to modify these Terms at any time.

The version in effect on the date services are booked shall govern that booking.

Agreement

By purchasing, scheduling, or using any Gulf Coast Pinnacle Media service, the Client acknowledges that they have read, understood, and agree to be legally bound by these Terms & Conditions.
